How will this turn out Arizona to appeal block on immigration law: governor?
PHOENIX, Arizona (AFP) – Arizona Governor Jan Brewer said Wednesday she would swiftly appeal a judges ruling blocking key parts of a new state immigration law, vowing to take it all the way to the Supreme Court.
"This fight is far from over. In fact, it is just the beginning, and at the end of what is certain to be a long legal struggle, Arizona will prevail in its right to protect our citizens," Brewer said in a statement.
She said the state would soon file an expedited appeal after District Judge Susan Bolton blocked parts of the law which would have given police the power to check the immigration status of all suspects.
Bolton also suspended parts of the law, which goes into effect on Thursday, requiring everyone to carry proof of their residency status and making it a crime for illegal immigrants to seek work.
Brewer signed the legislation into law in April and has argued that it is needed to battle a tide of illegal immigrants flooding into the state across the border with Mexico, blamed also for a spiralling crime wave.
"I will battle all the way to the Supreme Court, if necessary, for the right to protect the citizens of Arizona," Brewer said.
She said the law "represents another tool for our state to use as we work to address a crisis we did not create and the federal government has actively refused to fix."
But judge Bolton, who is hearing seven lawsuits challenging the legislation, wrote in her ruling that the Obama administration was likely to succeed in its argument that responsibility for immigration policy lies with the federal government.
"The court by no means disregards Arizonas interests in controlling illegal immigration and addressing the concurrent problems with crime including the trafficking of humans, drugs, guns and money," she wrote.
But she insisted "it is not in the public interest for Arizona to enforce preempted laws" which are set by the federal government.

WASHINGTON — The Supreme Court upheld an Arizona law Thursday that penalizes businesses for hiring workers who are in the United States illegally, rejecting arguments that states have no role in immigration matters.
By a 5-3 vote, the court said that federal immigration law gives states the authority to impose sanctions on employers who hire unauthorized workers.
The ruling cheered supporters of tougher immigration laws who said it would encourage states to take new steps, especially in the employment area.
The decision upholding the validity of the 2007 law comes as the state is appealing a ruling that blocked key components of a second, more controversial Arizona immigration enforcement law. Thursdays decision applies only to business licenses and does not signal how the high court might rule if the other law comes before it.
Still, the ruling placed the courts five Republican appointed justices on the side of the state, and against the Chamber of Commerce, which challenged the law along with the American Civil Liberties Union.
Chief Justice John Roberts, writing for the majority, said Arizonas employer sanctions law "falls well within the confines of the authority Congress chose to leave to the states."
Justices Stephen Breyer, Ruth Bader Ginsburg and Sonia Sotomayor, all Democratic appointees, dissented. The fourth Democratic appointee, Justice Elena Kagan, did not participate in the case because she worked on it while serving as President Barack Obamas solicitor general
Breyer said the Arizona law upsets a balance in federal law between dissuading employers from hiring illegal workers and ensuring that people are not discriminated against because they may speak with an accent or look like they might be immigrants.
Employers "will hesitate to hire those they fear will turn out to lack the right to work in the United States," he said.
The Obama administration backed the challenge to the law. The measure was signed into law in 2007 by Democrat Janet Napolitano, then the governor of Arizona and now Obamas Homeland Security secretary.
The employer sanctions law has been only infrequently used. It was intended to diminish Arizonas role as the nations hub for immigrant smuggling by requiring employers to verify the eligibility of new workers through a federal database. Employers found to have violated the law can have their business licenses suspended or revoked.
Rep. Lamar Smith, R-Texas, chairman of the House Judiciary Committee, praised the high courts decision. "Not only is this law constitutional, it is commonsense. American jobs should be preserved for Americans and legal workers," Smith said.
Lower courts, including the San Francisco-based 9th U.S. Circuit Court of Appeals, previously upheld the law.
Last month, a three-judge panel of that same appeals court upheld a trial judges ruling blocking enforcement of parts of the broader Arizona immigration law, known as SB1070. The provisions that were blocked include a requirement that police, while enforcing other laws, must question a persons immigration status if officers have reasonable suspicion the person was in the country illegally. State officials have said they will appeal the ruling to the Supreme Court.
The ACLUs Cecillia Wang said the Supreme Court decision was disappointing, but narrow. "The decision has nothing to do with SB1070 or any other state and local immigration laws," said Wang, director of ACLUs immigrant rights project.
But Jay Sekulow, chief counsel of the conservative American Center for Law and Justice, said the ruling should encourage states to play a larger role in immigration matters.
"While its not a definitive answer to the main Arizona case, it certainly is a helpful sign from our perspective," Sekulow said. He filed a brief in support of the law that was upheld Thursday.

Both Hazleton and Arizonas immigration laws make use of a narrow exception in the federal Immigration Reform and Control Act, which restricts states ability to fight the employment of illegal immigrants. The federal law prohibits states from imposing penalties on businesses that employ illegal immigrants except through licensing or permitting requirements.
Under the Arizona law, employers who intentionally employ illegal immigrants and fail to check the immigration status of new hires using a federal online database can have their business licenses revoked. Critics dubbed the sanction the "business death penalty."
In its 4-3 decision May 26, the Supreme Court ruled Arizonas law "fits within the confines" of the authority the federal immigration law reserves for states.
"In exercising that authority, Arizona has taken the route least likely to cause tension with federal law," Chief Justice John Roberts wrote.

The Supreme Court, already poised to decide one hot-button political issue during an election year, may also tackle the Obama administration’s challenge to Arizona’s law requiring its police to check the immigration status of people who are stopped.
In addition to opposing the Arizona law, the Obama administration has contested similar immigration enforcement laws adopted by Alabama, Georgia, South Carolina and Utah.
At issue is not only who can enforce the immigration laws but also what the policy should be for the millions of illegal immigrants living and working in the United States.
Obama’s lawyers would prefer for the Supreme Court to steer clear of the issue.
If the court votes to hear the case in the spring, it will elevate illegal immigration as a political issue.
