As some states like Utah look to put cops on the front lines of immigration enforcement, San Jose Police Chief Chris Moore and other prominent law enforcement officials warned Wednesday that using their shrinking pool of officers to target illegal immigrants is inefficient, costly and would make their cities more dangerous, not less. "I am looking at laying off 300 officers, so now more than ever I need to focus on partnerships with communities, Moore said during a national teleconference sponsored by the Police Executive Research Forum. "This (the issue of immigration enforcement) has become a wedge in our communities and we need to remove that wedge. The teleconference was part of a larger public effort by some high-profile police executives to communicate to political leaders and people that the increasing calls for more aggressive and local immigration enforcement efforts could adversely affect them. The officials noted, in particular, immigration crackdowns in Arizona and Utah and other proposals that seek to have local law enforcement enforce immigration laws, primarily a federal function. Looking to reassure its own large and growing Latino community, San Jose has long broadcast that it does not participate in immigration raids. And officers are ordered not to investigate someones immigration status during arrests. San Jose police are looking to greatly improve its frayed relationship with immigrant communities amid allegations of overaggressive policing and racial profiling. Moore, for example, has in his short tenure as chief discontinued a policy in which cars of unlicensed drivers stopped for minor traffic violations were impounded for a month -- a policy many felt unfairly targeted the undocumented Latino community. They are free to go, but US citizens will still get their cars impounded, can you wrap your head around that? I'm planning to abandon CA soon, it's turning into a complete garbage state. Could this be the major blow to Illegal Aliens we are hoping for, and set the state for other challenges? Well the Supreme Court held a highly anticipated argument in the case on Wednesday. I attended the arguments with Senator Pearce and my Judicial Watch attorney colleagues and here’s my read: It looks promising that State Senator Pearce’s law will be upheld for the reasons we outlined in our brief. And that was pretty much the takeaway by the press as well. CNN reported the Court offered “tenuous support” for the law. While Bloomberg suggested the Court was clearly “inclined” to uphold the lower court decision, which validated the law: U.S. Supreme Court justices signaled they are inclined to uphold an Arizona law that threatens companies with the revocation of their corporate charters if they hire illegal aliens. Chief Justice John Roberts and Justice Antonin Scalia took the lead in aiming a barrage of questions at a lawyer challenging the measure in an hour-long hearing in Washington. Roberts pointed to a federal statute that carves out a role for states while Scalia focused on what he said was the U.S. government’s failure to enforce its immigration laws. “What Arizona says has occurred here is that the scheme in place has not been enforced, and Arizona and other states are in serious trouble, financially and for other reasons, because of unrestrained immigration,” Scalia said. A ruling upholding the measure would spur enactment of similar laws elsewhere, advocates on both sides of the issue say. The warning follows an indictment unsealed this month in Texas federal court that accuses a Somali man in Texas of running a “large-scale smuggling enterprise” responsible for bringing hundreds of Somalis from Brazil through South America and eventually across the Mexican border. Many of the illegal immigrants, who court records say were given fake IDs, are alleged to have ties to other now-defunct Somalian terror organizations that have merged with active organizations like Al Shabaab, al-Barakat and Al-Ittihad Al-Islami. In 2008, the U.S. government designated Al Shabaab a terrorist organization. Al Shabaab has said its priority is to impose Sharia, or Islamic law, on Somalia; the group has aligned itself with Al Qaeda and has made statements about its intent to harm the United States. In recent years, American Somalis have been recruited by Al Shabaab to travel to Somalia, where they are often radicalized by more extremist or operational anti-American terror groups, which Al Shabaab supports. The recruiters coming through the Mexican border are the ones who could be the most dangerous, according to law enforcement officials. Security experts tell FOXNews.com that the influx of hundreds of Somalis over the U.S. border who allegedly have ties to suspected terror cells is evidence of a porous and unsecured border being exploited by groups intent on wrecking deadly havoc on American soil. The DHS alert was issued to police and sheriff’s deputies in Houston, asking them to keep their eyes open for a Somali man named Mohamed Ali who is believed to be in Mexico preparing to make the illegal crossing into Texas. Officials believe Ali has ties to Al Shabaab, a Somali terrorist organization aligned with Al Qaeda, said Joan Neuhaus Schaan, the homeland security and terrorism fellow at Rice University’s Baker Institute, who has seen the alert. In the Texas smuggling case, Anthony Joseph Tracy, of Virginia, who admitted to having ties to Al Shabaab, is currently being prosecuted for his alleged role in an international ring that illegally brought more than 200 Somalis across the Mexican border. Prosecutors say Tracy used his Kenya-based travel business as a cover to fraudulently obtain Cuban travel documents for the Somalis. The smuggled Somalis are believed to have spread out across the United States and remain mostly at large, court records show. Somalis are classified by border and immigration officials as “special interest” — illegal immigrants who get caught trying to cross the Mexican border into the U.S. who come from countries that are considered a high threat to the U.S., Neuhaus Schaan explained. DHS did not respond to multiple e-mail and phone requests for comment. Californias highest court is poised to be the next battleground in the debate over benefits for illegal immigrants as the justices have agreed to hear arguments on the constitutionality of a state law allowing undocumented students to pay in-state tuition at public colleges and universities. The decision could affect hundreds of illegal immigrant students who attend community colleges, Cal State and UC campuses and who say they would not be able to afford a higher education if required to pay out-of-state tuition, which can cost more than triple the amount that residents pay.But the outcome could have a broader effect -- at least nine other states, including Oklahoma, New York and Texas, have similar laws providing the reduced fees to illegal immigrants. Although a court decision would not be legally binding in other states, politicians around the country are looking at California as a litmus test for future legal challenges. The state Supreme Court accepted the case late last month and will probably hear arguments later this year. In a letter urging the high court to take up the case, Utahs Atty. Gen. Mark Shurtleff wrote, "The implications of this decision extend far beyond California, and far beyond a states ability to set educational policy, into the heart of the national debate about illegal immigration." Martinez vs. Regents of the University of California began with a lawsuit filed in Yolo County in 2005 by out-of-state students and their parents. The lawsuit alleges that education officials are violating federal law by granting in-state tuition to illegal immigrants while not offering the same lower fees to students from outside California. "U.S. citizens should have at least the same rights as undocumented immigrants," said one of the plaintiffs, Aaron Dallek, an Illinois native who graduated from UC Berkeley in 2006. Another plaintiff, 2006 UC Davis graduate Onson Luong, said he didnt think it was fair that he, as a native of Nevada, had to pay higher tuition than illegal immigrants. Luong, who majored in biotechnology, worked two jobs during college and owes $15,000 in student loans. "If they are allowing illegals to pay in-state tuition when they arent even citizens, what kind of message is that sending?" Luong asked. Comprehensive immigration reform is not only a practical solution to Americas illegal immigration problem, but also a moral obligation, said Salt Lake City Bishop John C. Wester. Wester is the chair of the United States Conference of Catholic Bishops committee on migration, which met earlier this month as part of National Migration Week. He said the USCCB is "doing a full-court press" on immigration reform. "We certainly honor the laws of the land and were grateful for them, but we do believe the system is no longer able to deal with the immigration realities we face today. We have great need for labor and invite immigrants to work, but then call it trespassing," Wester said. "We need temporary workers, but dont have sufficient visas." Wester said the two biggest challenges to passing reform legislation are the idea that immigrants steal jobs and that those in the country illegally will simply get a free pass to citizenship. Not only do immigrants create jobs in the long-term, Wester said, but immigration reform would also force employers to pay equal wages, which would give employers no incentive to hire immigrants over citizens. In the end, though, the United States needs to work with other governments to help them become able to care for their citizens so immigration is a choice rather than a necessity, he said. "What part of illegal dont you understand? is a quick sound bite," Wester said. "But if someone is breaking the law, you need to look at why the persons breaking the law." People come from countries around the globe to escape oppression or to provide for their families, he said, and the problems they are fleeing from need to be fixed before illegal immigration will become unnecessary. "Were all connected," he said. "This is all connected." Wester said Catholic theology also emphasizes that those countries that are more well off have an obligation to help those in a worse situation. He said they recognize countries have a right to enforce laws, but that its not an absolute right. "If a country does have the capital and the ability and the potential to help people, then there is a higher obligation on them and they cant hide behind laws," he said. "We cant look at it just through the prism of civil law, but need to consider, What are my responsibilities as a human being on the planet?" The Catholic Church is working with other faiths to achieve the comprehensive reform they believe is necessary, Wester said. They also support the Comprehensive Immigration Reform for Americas Security and Prosperity Act for 2009, a bill which Wester said they hope could be introduced as early as February. He said it is important to the bill to keep families together and provide sufficient legal routes for people to work in the country and work toward citizenship if they want to. While some groups in Utah are vehemently opposed to having immigrants in the country, Wester said he thinks most Utahns are hospitable at heart. Answer: Churches in this country are considered to be non-profit, charitable organizations and as such are exempt from taxes. However, as a condition of that status, they are prohibited from engaging in political activities (endorsing candidates, lobbying, etc.). If the Catholic Church is going to use the pulpit to lobby for political change, they must be treated as any other lobbyist group attempting to influence our elected representatives. While they claim that the motives behind their quest for amnesty for millions of mostly Hispanic illegal aliens are strictly humanitarian, the church also has very practical reasons for seeking amnesty…Their own survival. What the leadership of the Catholic Church always fail to acknowledge in their sanctimonious speeches is the fact that the U.S. dioceses are dying, and droves of devout Mexican and Central American Catholics is just what the church needs right now to save it. The time has come to force the church to decide whether it is either a church or a political organization. If it chooses the latter, the taxpayers should not be asked to subsidize their lobbying activities.

This is his story: My wife’s family came to visit for a few months and they repeatedly attempted to provoke confrontations between my wife and me. Ultimately, my wife assaulted me by punching me in the neck. I did not hit my wife back or abuse her in any way. I was arrested for 5th Degree Domestic Assault and spent three days in jail for a crime I did not commit and for not leaving my home under duress. While I was behind bars, my wife cleaned out the joint bank account. I later learned that a legal aide group called Civil Society Helps had assisted with my wife’s abuse claims to expedite her immigration application. This outfit helps many immigrant women to file false abuse claims under the Violence Against Women Act. Shortly after my release from jail, my wife asked me to write a letter to immigration stating I was an abusive husband. She promised if I wrote the letter she would help me get my home back. Instead of allowing myself to be blackmailed, I wrote the Citizenship and Immigration Service to withdraw the petition for my wife’s U.S. residency. I used my last credit card to retain a lawyer to petition for divorce. At that point I was broke, homeless, and sleeping in my car and under my desk at the office.The courts later granted my wife all of the marital property and ordered that I surrender to her a car that was titled in my name. To add insult to injury, the judge granted her a one year Order for Protection. She then telephoned me several times, calling me an “ABUSER” real slow and sarcastically. Knowing how groups like the Civil Society work, I can only imagine how they coached my wife. Several times my wife has been confronted by the Eagan, Minn. police for driving without a license. She was repeatedly given a warning, yet continued to drive the vehicle. Later, I spoke with one of the officers and reminded him it is against the law for anyone to drive a motor vehicle without a license or insurance. His partner threatened to arrest me for allegedly creating a public disturbance. But I had done nothing wrong and they backed off when I informed them I had a witness looking on. Last year I earned a very high salary, lived in a house by a lake, and enjoyed life as much as I could with a wife who didn’t love me. At age 36 I had no previous criminal history and had honorably completed four years of U.S. military service. In three days, I was reduced to living in poverty and was homeless for weeks. I am no longer employable in my field due to my “criminal” history — 5th degree domestic assault with no conviction. My house was recently foreclosed and I have lost everything. Thanks to our VAWA laws and a series of outright lies by an immigrant residency-seeker, a law-abiding American citizen can be left penniless. All of your assets can be seized and given to the immigrant even if you are innocent of the charges.
