AS many Americans know, last week Gov. John Baldacci of Maine signed a law that made this state the fifth in the nation to legalize gay marriage. Its worth pointing out, however, that there were some legal same-sex marriages in Maine already, just as there probably are in all 50 states. These are marriages in which at least one member of the couple has changed genders since the wedding.
I’m in such a marriage myself and, quite frankly, my spouse and I forget most of the time that there is anything particularly unique about our family, even if we are what is the phrase? differently married.
Deirdre Finney and I were wed in 1988 at the National Cathedral in Washington. In 2000, I started the long and complex process of changing from male to female. Deedie stood by me, deciding that her life was better with me than without me. Maybe she was crazy for doing so; lots of people have generously offered her this unsolicited opinion over the years. But what she would tell you, were you to ask, is that the things that she loved in me have mostly remained the same, and that our marriage, in the end, is about a lot more than what genders we are, or were.
Deirdre is far from the only spouse to find herself in this situation; each week we hear from wives and husbands going through similar experiences together. Reliable statistics on transgendered people always prove elusive, but just judging from my e-mail, it seems as if there are a whole lot more transsexuals and people who love them in New England than say, Republicans. Or Yankees fans.
Ive been legally female since 2002, although the definition of what makes someone legally male or female is part of what makes this issue so unwieldy. How do we define legal gender? By chromosomes? By genitalia? By spirit? By whether one asks directions when lost?
For our part, Deirdre and I remain legally married, even though were both legally female. If we had divorced last month, before Governor Baldaccis signature, I would have been allowed on the following day to marry a man only. There are states, however, that do not recognize sex changes. If I were to attempt to remarry in Ohio, for instance, I would be allowed to wed a woman only.
Gender involves a lot of gray area. And efforts to legislate a binary truth upon the wide spectrum of gender have proven only how elusive sexual identity can be. The case of Jnoel Gardiner, in Kansas, provides a telling example. Ms. Gardiner, a postoperative transsexual woman, married her husband, Marshall Gardiner, in 1998. When he died in 1999, she was denied her half of his $2.5 million estate by the Kansas Supreme Court on the ground that her marriage was invalid. Thus in Kansas, any transgendered person who is anatomically female is now allowed to marry only another woman.
Similar rulings have left couples in similar situations in Florida, Ohio and Texas. A 1999 ruling in San Antonio, in Littleton v. Prange, determined that marriage could be only between people with different chromosomes. The result, of course, was that lesbian couples in that jurisdiction were then allowed to wed as long as one member of the couple had a Y chromosome, which is the case with both transgendered male-to-females and people born with conditions like androgen insensitivity syndrome. This ruling made Texas, paradoxically, one of the first states in which gay marriage was legal.
A lawyer for the transgendered plaintiff in the Littleton case noted the absurdity of the countrys gender laws as they pertain to marriage: Taking this situation to its logical conclusion, Mrs. Littleton, while in San Antonio, Tex., is a male and has a void marriage; as she travels to Houston, Tex., and enters federal property, she is female and a widow; upon traveling to Kentucky she is female and a widow; but, upon entering Ohio, she is once again male and prohibited from marriage; entering Connecticut, she is again female and may marry; if her travel takes her north to Vermont, she is male and may marry a female; if instead she travels south to New Jersey, she may marry a male.
Legal scholars can (and have) devoted themselves to the ultimately frustrating task of defining male and female as entities fixed and unmoving. A better use of their time, however, might be to focus on accepting the elusiveness of gender and to celebrate it. Whether a marriage like mine is a same-sex marriage or some other kind is hardly the point. What matters is that my spouse and I love each other, and that our legal union has been a good thing for us, for our children and for our community.
Its my hope that people who are reluctant to embrace same-sex marriage will see that it has been with us, albeit in this one unusual circumstance, for years. Can we have a future in which we are more concerned with the love a family has than with the sometimes unanswerable questions of gender and identity? As of last week, it no longer seems so unthinkable. As we say in Maine, you can get there from here.

the basic point is that the law does not invalidate one’s marriage simply because someone changes their “sex” and once again, referencing your story you should know that we do not change our genders but rather our sexes..
with regards to the same sex marriage issues, this is literally a basic constitutional right and terminology. Many religions feel that the term marriage is a “god” given term for them to exclusively use to create a legal contract between two individuals. And by the churches definition those individuals must be defined under sanctions as male and female, bypassing the legal aspects.
The churches argument deals with their own self preservation of their own perversions, and by it they are in return directly violating the fist amendment of the United States constitution.
in the case of transsexual individuals, a marriage under the law is considered a union or business contract between two individuals, and under the bill of rights and constitution creating a law which invalidated such a contract would be prejudice against those individuals based upon church. Furthermore it would ridiculous to spend the time & money to single out an extremely small number of individuals who have married, effectively the same sex prior to gender affirmation surgery.

Whether same-sex civil unions become legal in Hawaii is now up to Republican Gov. Linda Lingle, whose office was flooded Friday with phone calls and e-mails from gay rights and religious groups after the bill won approval in the waning moments of the legislative session.
Lingle has long avoided saying whether she would veto the measure or allow it to become law. She has until July 6 to make a decision.
The governor was unavailable for comment Friday as she was scheduled to return from a trip to California, but her office reported a high volume of calls pouring in from both opponents and supporters of the legislation.
The bill was unexpectedly revived and cleared the Legislature on Thursday, the last day of this years session.
Religious groups dont plan the kind of large opposition rallies seen previously at the Hawaii Capitol. Instead, they will lobby Lingle directly with personal messages.
"Shes kept it very close to the vest," said Dennis Arakaki, executive director of the Hawaii Family Forum and Hawaii Catholic Conference. "She wont let us know how she feels about it. Now well know. ... The ball is in her court."
Hes sending e-mails to churches and text messages to supporters urging them to contact the governors office to let her know how they feel about the issue.
Civil union backers will send handwritten letters and postcards to Lingle in addition to e-mails and phone calls asking her to approve the legislation, said Tony Wagner, Western Regional Field Director for the Human Rights Campaign.
"Its going to be important to keep up the pressure on the governor in order to demonstrate that there is support for this bill and for treating all families equally," Wagner said.
In addition, civil union supporters will likely take to the streets to wave signs as drivers pass by, he said.
Lingle has sent mixed signals: She wanted lawmakers to drop the issue because the state had more pressing budget matters to deal with, but she also said representatives should have put their votes on the record when they postponed a decision on the measure in January.
Her office sent an e-mail soliciting public comments on all legislation passed during this years session. Civil unions werent specifically mentioned.
"I encourage the public to continue to participate in the legislative process by providing input on the impact each piece of legislation would have on our state," Lingle said in the e-mail.
Lt. Gov. James "Duke" Aiona, who is seeking the Republican nomination for governor this fall, wants the bill vetoed.
"If the Legislature wanted to establish the equivalent of same-sex marriage, they should have put it on the ballot for the people to decide," Aiona said in a statement. "This bill should not be allowed to become law."
If approved, Hawaii will become one of six states - along with California, Nevada, New Jersey, Oregon and Washington - to grant essentially all the rights of marriage to same-sex couples without authorizing marriage itself.
Five other states and the District of Columbia permit same-sex marriage: Iowa, Vermont, New Hampshire, Massachusetts and Connecticut.
The Aloha State has been a battleground in the gay rights movement since the early 1990s.
A 1993 Hawaii Supreme Court ruling nearly made Hawaii the first state to legalize same-sex marriage before voters in the state overwhelmingly approved the nations first "defense of marriage" constitutional amendment in 1998.
The measure gave the Legislature the power to reserve marriage to opposite-sex couples. It resulted in a law banning gay marriage in Hawaii but left the door open for civil unions.
"I dont know where the governor is going to be on this issue," said Tambry Young, co-chair of Equality Hawaii. "Were hoping she sees it as an equality issue."
Although Lingle has until July 6 to make a decision, her intentions will be known sooner. She must send the Legislature a list of bills that shell potentially veto by June 22. Measures not on that list would become law, either with or without her signature.

Answer: I don't know what Lingle will do; I can't read her mind. I do know the following, however:
*Hawaii is a strongly Democratic state, though Lingle calls herself a Republican
*Lingle herself is gay
*Lingle is the outgoing governor.
I am an employee of the Hawaii Dept. of Education. Lingle has angered MANY people in this state over the past nine months as she has chopped the education budget and instituted 17 school furlough days for the 2009-10 school year. We are still waiting to hear whether or not there will be furloughs during the 2010-11 school year. Kids missed nearly 10% of their school days this year (17 out of 180) and I lost out on nearly 10% of my pay. Besides that, Lingle has done some other shady things during her tenure as governor. She overrode the state law for an Environmental Impact Study (EIS) for the now-defunct Hawaii SuperFerry. Now the state is out millions of dollars for the ferry AND it is gone, so it cost us money for NOTHING.
I hope that Lingle does see this as an equality issue, because that's what it is. Regardless of what she does, it won't affect her personally as she is on her way out of the governor's mansion.

OLYMPIA, Wash. (AP) — Gov. Chris Gregoire handed gay rights advocates a major victory, signing into law a measure that legalizes same-sex marriage in Washington state, making it the seventh in the nation to allow gay and lesbian couples to wed.
Gregoire signed the bill surrounded by gay rights supporters. "Im proud our same-sex couples will no longer be treated as separate but equal," she said.
Its a historic moment, but same-sex couples cant walk down the aisle just yet.
The law takes effect June 7, but opponents on multiple fronts already are preparing to fight.
Opponents planned to file a challenge Monday that could put the law on hold pending the outcome of a November vote. Separately, an initiative was filed at the beginning of the session that opponents of gay marriage say could lead to the new law being overturned.
The state reception room at the Capitol was packed with gay rights supporters and at least 40 lawmakers from the House and Senate
Sen. Ed Murray, a Seattle Democrat who is gay and has sponsored gay rights legislation for years, told the cheering crowd: "My friends, welcome to the other side of the rainbow. No matter what the future holds, nothing will take this moment away from us."
As the Democratic governor signed the legislation, a man shouted, "Do not betray Christ!" However, his voice was overwhelmed by gay-marriage supporters who cheered and spoke loudly during his outburst.
Bob Struble, 68, of Bremerton, was removed from the room and said he was given a warning by security. Struble said he believes the state will halt gay marriage in a public vote. "Well be doing everything we can to overturn this unfortunate law," he said
Meanwhile, Republican presidential candidate Rick Santorum, who opposes gay marriage, was in town speaking with conservative voters. Santorum also planned to meet with Republican lawmakers at the Capitol later Monday.
Gregoires signature comes nearly a week after a federal appeals court declared Californias ban on gay marriage unconstitutional, saying it was a violation of the civil rights of gay and lesbian couples.
A three-judge panel of the 9th Circuit Court of Appeals gave gay marriage opponents time to appeal the 2-1 decision against Proposition 8 before ordering the state to allow same-sex weddings to resume. The judges also said the decision only applies to California, even though the court has jurisdiction in nine Western states.
Washington state has had domestic partnership laws since 2007, and in 2009 passed an "everything but marriage" expansion of that law, which was ultimately upheld by voters after a referendum challenge.
Opponents said they would file a ballot challenge after Gregoire signed the measure that would require voters in November to either uphold or overturn the law. If the referendum gets enough signatures the law is put on hold pending the outcome of a November vote.
Separately, an anti-gay marriage initiative was filed at the beginning of the session, but the language is still being worked out so no signatures have been collected yet. An initiative alone would not pause the law.
Gay marriage is legal in New York, Connecticut, Iowa, Massachusetts, New Hampshire, Vermont and Washington, D.C.
Same-sex marriage also has the backing of several prominent Pacific Northwest businesses, including Microsoft Corp., Nike Inc. and Starbucks Corp.
Legislative committees in Maryland heard testimony on gay marriage last week. Lawmakers in New Jersey are expected to vote on gay marriage soon, with a vote in the state Senate on Monday and a vote in the Assembly on Thursday.
N.J. Gov. Chris Christie, who is pushing for a public vote on the issue, says hell veto the bill if it comes to his desk. Maine could see a gay marriage proposal on the November ballot.
Proposed amendments to ban gay marriage will be on the ballots in North Carolina in May and in Minnesota in November.
