In one of the main legal challenges against the health care reform passed last year, the 11th Circuit U.S. Court of Appeals in Atlanta declared the laws "individual mandate" unconstitutional, calling it an "unprecedented exercise of congressional power." The 2-1 ruling constitutes the first time a Democrat-appointed judged has struck down the mandate. Federal judges have been weighing in on the bills constitutionality for a while now and health care reporters and pundits are weighing in on where the ruling leaves the legislation.
This is headed for the Supreme Court. "If there was ever any doubt that the long-raging debate over the constitutionality of the federal health-care overhaul... would ultimately be settled by the U.S. Supreme Court, that doubt was all but extinguished today," writes Ashby Jones at The Wall Street Journals Law Blog. Steve Benen at the Washington Monthly agrees: "With the 6th and 11th circuits in conflict, there is now no real doubt that the Supreme Court will have to hear the case. We can probably expect a ruling next June — about five months before the presidential election."

Supreme Court judge Clarence Thomas has failed to disclose his wifes income from working for the tea party group Liberty Central, which fought President Obamas health care reform law. His new financial disclosure form indicates that his wife, Virginia, who served as Liberty Centrals president and CEO, received $150,000 in salary from the group and less than $15,000 in payments from an anti-health care lobbying firm she started.
The disclosure was apparently prompted in part by Rep. Anthony Weiner (D-N.Y.), who had been needling Thomas (including on Twitter) for months to disclose how much money his wife earned from Liberty Central. Thats because challenges to Obamas health care reform law are likely to end up before the Supreme Court sooner rather than later, and if Thomas and his wife benefited from her income working against the bill, the justice has an enormous conflict of interest in hearing any legal challenge. So how can Obama as a constitutional lawyer not know this and not know the supreme court will hand illegals coverage as soon as its challenged and brought to them.

It surprises me that so many Americans seem not to be aware about Obama’s healthcare plans [a]. During the election, he campaigned for these changes stating that he felt it was unfair to have a system where insurance companies try to escape paying claims and was elected to bring in changes [b].
First of all, too many people do not know that Obama wants to make insurance more available to all. His system is similar to that which works in Holland, Taiwain [c] and Switzerland. It works there and private healthcare companies provide most the insurance to the people there.
FACT - the USA spends more on healthcare PER PERSON than any other nation on the planet [d].
FACT – insurance companies admit that they push up costs, buy politicians and do not pay out for many claims when they should [e].
FACT - the US has higher death rates for kids aged under five than western European countries with universal health coverage [f].
That means that a dead American four year old would have had a better chance of life if they were born in Canada, France, the Netherlands, Cuba, Switzerland, Germany, Japan etc, all of which have universal health coverage. And no western European nation with universal healthcare has moved away from it.

ATLANTA – Judges on a federal appeals court panel on Wednesday repeatedly raised questions about President Barack Obamas health care overhaul, expressing unease with the requirement that virtually all Americans carry health insurance or face penalties.
All three judges on the 11th Circuit Court of Appeals panel questioned whether upholding the landmark law could open the door to Congress adopting other sweeping economic mandates. The panel is made up of two Democratic appointees and one Republican appointee.
The Atlanta panel did not immediately rule on the lawsuit brought by 26 states, a coalition of small businesses and private individuals who urged the three to side with a Florida judge who struck down the law. And its never easy to predict how an appeals panel will decide.
But during almost three hours of oral arguments, the judges asked pointed questions about the so-called individual mandate, which the federal government says is needed to expand coverage to tens of millions of uninsured Americans. With other challenges to the law before other federal appeals courts, lawyers expect that its fate will ultimately be decided by the U.S. Supreme Court.
Chief Judge Joel Dubina, who was tapped by President George H.W. Bush, struck early by asking the governments attorney "if we uphold the individual mandate in this case, are there any limits on Congressional power?" Circuit Judges Frank Hull and Stanley Marcus, who were both appointed by President Bill Clinton, echoed his concerns later in the hearing.
"Youre required to have auto insurance. And our freedoms havent crumbled because of it."

Answer: Great question, and a difficult one to answer. There are many things that could affect the impact. There could be some other issue at that time that is so pressing that the health care issue will be secondary. That said, here is my best guess on the 2 scenarios you presented.
If the case is decided in Obama's favor, the law would stand for now. It could still be repealed by our elected officials (Congress and the President), and the law's opponents would certainly double their efforts to get their candidates elected. However, they have for months been telling us the law is unconstitutional, and a ruling by the Supreme Court against them would hurt their crediblity. Also, it would no longer just be enough to criticize Obama. They are going to have offer an alternative program, which will also be open for criticism. If the economy is still struggling, like it is now, there are many Americans who will be faced with loosing their jobs. Most of these will loose their health insurance as well. The GOP will have to tell them why not having affordable health care is a good thing. So I think on the balance, such a ruling will help Obama.
If the court strikes down the law, Obama will appear very ineffective. He will have spent his whole first term fighting for something that turned out to be a waste of time. He will probably be hurt by the ruling.
Things could still go either way for both scenarios. Much will depend on which side controls the narrative.
