1. Two previous rulings siding with the dems, ruled on the commerce clause and agreed with the dems as a single challenged element of the Health care law. ( known as Obamacare ). 2. The Florida Federal judge just ruled that no "severability" was placed into Obamacare as congress ( Pelosi & Reid ) should have done by congressional parliamentary procedure. This would of allowed any specific element to be challenged in court leaving the the balance of Obamacare to be left intact. 3. In the absence of "severability" which was not reviewed by the two fed judges ruling in the dems behalf, then tossing out one element, must be attached to the entire Obamacare law. 4. The Florida Federal judge got it correct.......and now based on this federal judge tossing out the entire Obamacare law....only a Federal Court of Appeals can touch it. Oh......dont assume the San Francisco based 9th Circuit court of appeals may take it on as they just got overturned 3 times in the last 3 weeks on other cases by SCOTUS who said the Constitution is the supreme document.....not a panel of judges who find theyre against it. Do you see Pelosi, Reid and Obama now realize theyve painted themselves into a corner? The Florida Judge ruling...."Because the individual mandate is unconstitutional and not "severable", the entire act must be declared void. I am fourteen, and have written a persuasive speech for Social Studies. The speech has to be about a reform that you believe in. And feedback, advice, suggestions, etc. would be greatly appreciated!!! When those qualities of life you’ve always enjoyed are no longer there for you, is it time to end your life? The Death with Dignity act gives terminally ill patients the choice of life or death. The debate began in 1990, with the case of Cruzan v. Director, Missouri Department of Health. A child was involved in a car accident that left her in a persistent vegetative state. This means that she was alive, but not living. Her brain damage was permanent. Two weeks after the accident, her parents decided to let her go, but the state hospital officials refused to pull the plug without court approval. Their case reached the Supreme Court. The final ruling was that an incompetent person was not able to exercise the right to refuse treatment. The measure stating that Oregon physicians had the permit to write a prescription for lethal drugs to qualified terminally ill patients was passed on November 8, 1994. The residents of Oregon voted on the act. 51.3 percent votes were cast in favor of the measure, while 48.7 percent were cast against. The right to humanely end one’s life by prescription drugs should be available to all terminally ill patients across the nation. Today, I will tell you a story. Then, I will share with you present-day statistics. Lastly, I will persuade you with the measures regulations. My aunt lived in California. She had ovarian cancer. At the time of her diagnosis, she was given less than two years to live. She went through chemotherapy, and she had an operation. Her ovaries were removed, and her stomach was scraped. Unfortunately, she kept dying. She called her sister, my grandma, inquiring about the prescription that would humanely end her life. She wanted to come up to Oregon, and see a few doctors. She would bring her medical documents, and pretend that she was a resident. A follow-up appointment with a doctor here in Oregon was required, and she would have had to stay with my grandma for a total of two weeks. The end was near, and she knew it. She opted out and stayed in California so that she could be with her family. The last two weeks of her life were horrendous. She was very ill. When she vomited, she vomited blood. She couldn’t eat, so she starved. Her body was shutting down. She slept for most of the time in an attempt to escape the pain. One day, she was wheeled into her living room. She looked at my grandma, who was visiting, and said, “I’m ready for my Oregon pills now.” My grandma replied, “I’m so sorry. We tried our best.” If she had taken them right then, it would have saved her from four more days of hell. She died in pain, along with so many others that merely could not get a hold of the drugs that would have allowed them to peacefully pass on. I will now share with you the Death with Dignity act statistics. In ten years, 541 Oregonians have requested the lethal prescriptions. Of that 541, 341 patients have actually ingested the drugs. Still, that is 341 lives saved from, say, four more days of hell. The average patient to use the drug is seventy-years-old. 81.8 percent of patients suffer from cancer, and 95.1 percent have experienced no complications. If you still don’t agree with the Death with Dignity act, here are the laws regulations. Terminally ill people have not flocked to Oregon from other states in attempt to end their lives by assisted suicide, and the safeguards against abuse towards the right appears to be effective. The Oregon law required that the patient self-administers the prescribed medication to hasten death. The law also ensures that the patient is the driving force. Sue Williams, head of the local Right to Life group, campaigned against the Death with Dignity act. She said, “I don’t think you can have a dignified death when you choose to kill yourself. This law is a bad law.” I disagree, along with so many others. Glenn Elfman, a sixty-two-year-old terminal-cancer patient, said that the Death with Dignity act “…provides an option for me as a patient, a person suffering from a terminal illness when the medical profession has run out of all other options.” I believe that the Death with Dignity act should be legal in all fifty states. Share with the world, and tell them of all the peace that has been restored to the suffering through the Death with Dignity act. The residents of Oregon, and now Washington, have a choice, but why not give everyone that choice? I believe that every U.S. citizen that is terminally ill should be given the chance to make their own decision, whether it be life or death.

Abortion Law: Did Roe v. Wade Recognize a Fetus as "Living?"?

Some people are arguing that Roe v. Wade agreed that life begins at conception and that a fetus is a life. They say that the only thing the court said was that a mothers right to privacy trumps that life. Here is the statement: "in Roe v. Wade, the US Supreme Court never denies that a fetus is a human life. The SC recognized that the fetus is a life, and that the state had a legitimate interest to protect the health and safety of that life. Instead, the SC ruled that the states iinterest in protecting the safety and welfare of that life was outweighed by the mothers right to privacy. The decision is based on the womans right to privacy, which is not an express right in the Consititution, but rather one that the Court implied from a line of illegal search and seizure cases." I see nowhere in Roe v. Wade the court saying anything about life. Would someone well acquainted with the law confirm or discredit these claims that in Roe v. Answer: Yes. It is stupid to say the mother's right to murder her child outweighs the child's right to live. Tthe fetus has unique human DNA and so is not part of the mother's body but is a separate human life. Only a liar can deny that scientific fact. No one should have the right to murder their baby. Our founding fathers wrote of a right to life but did not mention a right to murder a child.

Poor Obama, all his dreams are poised to be shattered. In one of the main legal challenges against the health care reform passed last year, the 11th Circuit U.S. Court of Appeals in Atlanta declared the laws "individual mandate" unconstitutional, calling it an "unprecedented exercise of congressional power." The 2-1 ruling constitutes the first time a Democrat-appointed judged has struck down the mandate. Federal judges have been weighing in on the bills constitutionality for a while now and health care reporters and pundits are weighing in on where the ruling leaves the legislation. This is headed for the Supreme Court. "If there was ever any doubt that the long-raging debate over the constitutionality of the federal health-care overhaul... would ultimately be settled by the U.S. Supreme Court, that doubt was all but extinguished today," writes Ashby Jones at The Wall Street Journals Law Blog. Steve Benen at the Washington Monthly agrees: "With the 6th and 11th circuits in conflict, there is now no real doubt that the Supreme Court will have to hear the case. We can probably expect a ruling next June — about five months before the presidential election."

When Gay Rights and Religious Liberties Clash by Barbara Bradley Hagerty NPR.org, June 13, 2008 · In recent years, some states have passed laws giving residents the right to same-sex unions in various forms. Gay couples may marry in Massachusetts and California. There are civil unions and domestic partnerships in Vermont, New Jersey, Connecticut, New Hampshire and Oregon. Other states give more limited rights. Armed with those legal protections, same-sex couples are beginning to challenge policies of religious organizations that exclude them, claiming that a religious groups view that homosexual marriage is a sin cannot be used to violate their right to equal treatment. Now parochial schools, "parachurch" organizations such as Catholic Charities and businesses that refuse to serve gay couples are being sued — and so far, the religious groups are losing. Here are a few cases: Adoption services: Catholic Charities in Massachusetts refused to place children with same-sex couples as required by Massachusetts law. After a legislative struggle — during which the Senate president said he could not support a bill "condoning discrimination" — Catholic Charities pulled out of the adoption business in 2006. Housing: In New York City, Yeshiva Universitys Albert Einstein College of Medicine, a school under Orthodox Jewish auspices, banned same-sex couples from its married dormitory. New York does not recognize same-sex marriage, but in 2001, the states highest court ruled Yeshiva violated New York Citys ban on sexual orientation discrimination. Yeshiva now allows all couples in the dorm. Parochial schools: California Lutheran High School, a Protestant school in Wildomar, holds that homosexuality is a sin. After the school suspended two girls who were allegedly in a lesbian relationship, the girls parents sued, saying the school was violating the states civil rights act protecting gay men and lesbians from discrimination. The case is before a state judge. Medical services: A Christian gynecologist at North Coast Womens Care Medical Group in Vista, Calif., refused to give his patient in vitro fertilization treatment because she is in a lesbian relationship, and he claimed that doing so would violate his religious beliefs. (The doctor referred the patient to his partner, who agreed to do the treatment.) The woman sued under the states civil rights act. The California Supreme Court heard oral arguments in May 2008, and legal experts believe that the womans right to medical treatment will trump the doctors religious beliefs. One justice suggested that the doctors take up a different line of business. Psychological services: A mental health counselor at North Mississippi Health Services refused therapy for a woman who wanted help in improving her lesbian relationship. The counselor said doing so would violate her religious beliefs. The counselor was fired. In March 2001, the United States Court of Appeals for the Fifth Circuit sided with the employer, ruling that the employees religious beliefs could not be accommodated without causing undue hardship to the company. Civil servants: A clerk in Vermont refused to perform a civil union ceremony after the state legalized them. In 2001, in a decision that side-stepped the religious liberties issue, the Vermont Supreme Court ruled that he did not need to perform the ceremony because there were other civil servants who would. However, the court did indicate that religious beliefs do not allow employees to discriminate against same-sex couples. Adoption services: A same-sex couple in California applied to Adoption Profiles, an Internet service in Arizona that matches adoptive parents with newborns. The couples application was denied based on the religious beliefs of the companys owners. The couple sued in federal district court in San Francisco. The two sides settled after the adoption company said it will no longer do business in California. Wedding services: A same sex couple in Albuquerque asked a photographer, Elaine Huguenin, to shoot their commitment ceremony. The photographer declined, saying her Christian beliefs prevented her from sanctioning same-sex unions. The couple sued, and the New Mexico Human Rights Commission found the photographer guilty of discrimination. It ordered her to pay the lesbian couples legal fees ($6,600). The photographer is appealing. Wedding facilities: Ocean Grove Camp Meeting Association of New Jersey, a Methodist organization, refused to rent its boardwalk pavilion to a lesbian couple for their civil union ceremony. The couple filed a complaint with the New Jersey Division on Civil Rights. The division ruled that the boardwalk property was open for public use, therefore the Methodist group could not discriminate against gay couples using it. In the interim, the states Department of Environmental Protection revoked a portion of the associations tax benefits. The case is ongoing. Youth

These persons are called to fulfill God's will in their lives and, if they are Christians, to unite to the sacrifice of the Lord's Cross the difficulties they may encounter from their condition. Homosexual persons are called to chastity. By the virtues of self-mastery that teach them inner freedom, at times by the support of disinterested friendship, by prayer and sacramental grace, they can and should gradually and resolutely approach Christian perfection.

Why did Palin change her mind on benefits for same sex couples?

In the debate last Thursday, Palin said she supports benefits for same sex couples. But she felt very differently 2 years ago when same-sex couples sued the state of Alaska for equal benefits and Palin went to great lengths to deny them, agreeing to extend the benefits only when the Supreme Court ruled that she had to. “Gov.
